1. WHO WE ARE

This website, aquafilterwarehouse.eu, is operated by NuAqua Filtration Ltd, trading as Aqua Filter Warehouse. We are registered in Ireland under company number 767959, at Nesta Business Centre, Kylemore Road, Inchicore, Dublin D10 CA33, Ireland. You can reach us at info@nuaqua.ie.

Throughout these terms, "we", "us" and "our" mean NuAqua Filtration Ltd, and "you" means the person using this website or buying from it.

2. ABOUT THESE TERMS

These terms apply to your use of this website and to anything you buy from it. By browsing the site or placing an order you accept them. Please read them before you order. Our privacy policy, shipping policy and refund policy form part of these terms.

Nothing in these terms affects your legal rights as a consumer. Where anything here conflicts with a right the law gives you, the law wins.

3. USING THIS WEBSITE

You may use this site to browse our products and place orders. You may not use it for any unlawful purpose, attempt to interfere with how it works, or copy its content for a competing commercial use.

We do our best to keep the site available and accurate, but we do not guarantee it will be uninterrupted or free of errors.

4. PRODUCTS, PRICES AND AVAILABILITY

Prices are shown in euro and include VAT where it applies. Delivery is charged separately unless the product page says otherwise. Where a product page says installation is included, the price shown covers both the product and its installation.

We try to show product photographs and descriptions accurately, but colours and finishes can vary between screens, and manufacturers occasionally change a specification. If what arrives is materially different from what was described, tell us and we will put it right.

All products are subject to availability. Prices can change, but a change after you have placed an order does not affect that order.

If a product is listed at an obviously incorrect price through a genuine error, we may cancel the order and refund you in full rather than supply at that price. We will tell you before doing so.

5. PLACING AN ORDER

When you place an order you are making an offer to buy. The order confirmation email we send is an acknowledgement that we have received it, not an acceptance. A contract between us comes into being when we dispatch the goods, or, for orders that include installation, when we confirm your installation date.

We may refuse or cancel an order where a product is unavailable, where we suspect fraud, where the price was wrong, or where we cannot deliver or install at your address. If we do, we refund you in full.

6. PAYMENT

Payment is taken at the checkout through the payment methods shown there. We do not store your card details. Where a product is sold on the basis of a deposit with the balance due on the day of installation, that is stated clearly on the product page.

7. DELIVERY

We ship within Ireland and across Europe. Delivery costs and timescales are set out in our shipping policy. Risk in the goods passes to you when they are delivered.

If your order has not arrived when you expected it, contact us and we will chase it with the courier.

8. INSTALLATION

Where installation is included in a price, it is carried out by our own engineers and is available in Ireland only. Installation elsewhere is not included in any listed price.

We will contact you to agree a date and time. You will need to give our engineer access to your mains water supply and enough space to fit the system. If we arrive and the installation cannot proceed for a reason outside our control, such as no access or unsuitable plumbing, we may charge a reasonable call out fee, and we will tell you the amount before charging it.

Our engineer will explain how the system works before leaving. If something is not right afterwards, contact us.

9. YOUR RIGHT TO CANCEL

If you are a consumer buying at a distance, you have a legal right to cancel your order within 14 days of receiving the goods, without giving a reason. We give you 30 days, which is longer than the law requires.

To cancel, email info@nuaqua.ie with your order number before that period ends. Please wait for our return instructions before sending anything back. The full detail, including the condition goods must be returned in, is in our refund policy.

Installation is a service, and services are treated differently. If you ask us to install a system within your cancellation period and the installation is completed, you lose the right to cancel that installation service, although your right to cancel in respect of the goods is unaffected. If you cancel after we have started but not finished the installation, you pay for the work done up to that point.

Cancellation does not apply to products made or configured specifically for you.

10. RETURNS AND REFUNDS

Our refund policy sets out how returns work and what can and cannot be returned. Refunds are made to the payment method you used, once we have received the goods back or you have shown that you have sent them.

11. FAULTY GOODS AND YOUR LEGAL RIGHTS

Goods we sell must be of merchantable quality, fit for purpose and as described. If something is faulty, tell us and we will repair it, replace it or refund you, in line with your rights under Irish consumer law. These rights sit alongside any manufacturer's warranty and are not replaced by it.

12. WARRANTIES

Warranty periods differ between products and are stated on the relevant product page. A warranty covers the parts and terms it says it covers. It does not cover damage from misuse, from work carried out by someone else, or from failing to service or replace filters when they are due.

13. OUR LIABILITY

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

We are not liable for business losses. If you use a product for a commercial purpose, we have no liability to you for loss of profit, loss of business or business interruption.

14. YOUR ACCOUNT

If you create an account, keep your password to yourself and tell us if you think someone else has used it. You are responsible for what happens under your account.

15. REVIEWS AND ANYTHING YOU SEND US

If you send us a review, a photograph or a comment, you allow us to use it on this site and in our marketing without payment. Do not send anything unlawful, misleading, or that belongs to someone else. We may edit or remove anything sent to us.

16. LINKS TO OTHER SITES

This site may link to sites we do not run. We are not responsible for their content or for anything you buy from them.

17. YOUR PRIVACY

How we handle your personal information is set out in our privacy policy.

18. COMPLAINTS

If something has gone wrong, email info@nuaqua.ie and give us the chance to sort it out. If you are not satisfied with how we handle it, you can contact the Competition and Consumer Protection Commission at ccpc.ie.

19. CHANGES TO THESE TERMS

We may update these terms. The version on this page at the time you place an order is the version that applies to that order.

20. GOVERNING LAW

These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer resident in another EU member state, you keep the protection of the mandatory consumer law of the country you live in.
